1. Introduction

Welcome to AiCoachess ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered chess analysis service, including our website at aicoachess.app and all related services (collectively, the "Service").

2. Our Services

AiCoachess provides AI-powered chess game analysis services, including:

• Advanced AI Analysis: Professional chess game evaluation using cutting-edge artificial intelligence
• Personalized Coaching: Detailed improvement recommendations tailored to your playing level
• Visual Reports: Game flow graphs showing critical moments and evaluation trends
• PDF Downloads: Professional analysis reports you can save and review offline
• Multi-Language Support: Reports available in 15+ languages
• Two Service Tiers:
  • Single Analysis: €1.00 per game
  • Unlimited Monthly: €6.99/month with 14-day free trial

3. Account Registration

To use our Service, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Be at least 13 years old (or the age of digital consent in your jurisdiction)
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Not share your account with others or create multiple accounts
• Notify us immediately of any unauthorized use of your account

4. Payment Terms

4.1 Merchant of Record

Paddle.com Market Ltd (for users outside the United States) or Paddle.com Inc (for US users) acts as the Merchant of Record for all purchases. Paddle is responsible for:

• Processing all payments securely
• Handling currency conversion
• Collecting and remitting applicable taxes (VAT, sales tax, etc.)
• Issuing invoices and receipts
• Processing refunds

4.2 Pricing

Our current pricing is:

• Single Analysis: €1.00 per game analysis (one-time payment)
• Unlimited Monthly: €6.99 per month with automatic renewal

All prices are in Euros (EUR) unless otherwise stated. Paddle may convert to your local currency at checkout.

4.3 Payment Methods

We accept payment methods supported by Paddle, including major credit cards, debit cards, and other payment options available in your region.

4.4 Taxes

Prices may not include applicable taxes. Paddle will calculate and collect any required taxes (VAT, GST, sales tax, etc.) based on your location at the time of purchase.

4.5 Price Changes

We reserve the right to modify our pricing at any time. Price changes will not affect existing subscriptions until renewal.

5. Subscriptions

5.1 Free Trial

New subscribers to our Unlimited Monthly plan receive a 14-day free trial. During the trial:

• You have full access to unlimited analysis
• You may cancel at any time without being charged
• If you do not cancel before the trial ends, you will automatically be charged €6.99 for the first month

5.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly) unless you cancel at least 48 hours before the renewal date. You will be charged between 00:00 and 01:00 UTC on the renewal date.

5.3 Cancellation

You may cancel your subscription at any time through:

• Your account settings on our website
• Contacting us at aicoachess@gmail.com

To ensure cancellation before the next billing cycle, please cancel at least 48 hours before your renewal date. Upon cancellation:

• You will retain access until the end of your current billing period
• You will not be charged for subsequent periods
• Your subscription will not automatically renew

5.4 No Partial Refunds for Subscriptions

There are no refunds for unused portions of subscription periods. If you cancel, you keep access until the end of your current paid period.

6. Refund Policy

6.1 Refund Processing

Refund requests will be processed as follows:

• We will respond to your request within 2 business days
• Approved refunds will be processed within 5-7 business days
• Refunds will be issued to your original payment method
• Paddle handles all refund processing

6.2 After 14 Days

Refund requests received after 14 days from the date of purchase may be considered at our sole discretion on a case-by-case basis. We may refuse refund requests if we find evidence of fraud, refund abuse, or other manipulative behavior.

6.3 Subscription Refunds

For subscriptions:

• The 14-day refund period applies to your initial subscription purchase
• Subsequent automatic renewals follow the same 14-day refund policy
• No refunds are provided for unused portions of a subscription period if you cancel mid-period
• You retain access until the end of your paid period even if you request a refund after cancellation

6.4 Consumer Rights

This refund policy does not affect your statutory rights as a consumer under applicable law, including rights related to products that are defective, not as described, or not fit for purpose.

7. Acceptable Use

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract our AI models or algorithms
• Use automated systems (bots, scripts, etc.) to abuse or overload our Service
• Share, resell, or commercially exploit analysis reports without our written permission
• Use the Service to violate any chess platform's terms of service
• Upload malicious code, viruses, or harmful content
• Impersonate others or provide false information
• Harass, abuse, or harm other users or our staff
• Attempt to gain unauthorized access to our systems
• Use the Service for any fraudulent or illegal activity

8. Intellectual Property

8.1 Our Rights

All content, features, and functionality of our Service, including but not limited to:

• Software, code, and algorithms
• AI models and training data
• Text, graphics, logos, and design
• Trademarks and branding

are owned by AiCoachess, our licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Your License

When you purchase an analysis, we grant you a limited, personal, non-transferable license to:

• Use the analysis report for your personal chess improvement
• Download and save the PDF report
• Share the report with your chess coach for educational purposes

8.3 Restrictions

You may NOT:

• Sell, license, or distribute analysis reports commercially
• Modify, adapt, or create derivative works from our reports
• Remove any copyright or proprietary notices

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

When you make a purchase through Paddle, their Privacy Policy also applies to your payment and transaction data.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR COMPLETENESS

10.1 No Guarantee of Results

While we strive for accuracy, we do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• AI analysis will be 100% accurate in all cases
• Using our recommendations will improve your chess rating
• The Service will meet all your specific requirements
• Defects will be corrected

10.2 Chess Improvement

Our analysis provides educational insights and suggestions. Actual improvement in chess skill depends on many factors including practice, study, and natural aptitude. We make no guarantees regarding rating improvements or competition results.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AICOACHESS SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA
• STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Termination

12.1 By You

You may terminate your account at any time by:

• Canceling your subscription (if applicable)
• Contacting us at aicoachess@gmail.com to request account deletion

12.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse our Service or staff
• Fail to pay fees when due

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• You lose access to your account and stored analyses
• You remain responsible for any fees incurred before termination
• Sections of these Terms that by their nature should survive (privacy, disclaimers, liability) continue to apply

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting a notice on our website
• Sending an email to your registered email address
• Displaying a notification when you log in

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and may cancel your account.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

For Consumers: Nothing in these Terms affects your statutory rights as a consumer under applicable local law. You may have additional rights under the laws of your country of residence.
